RULES AND REGULATIONS FOR MASS EVENT – FESTIVALAND 3

organized on December 31, 2025 at Centrum Expo XXI, Prądzyńskiego 12/14, 01-222 Warsaw (hereinafter: "Event")

§ 1. General Provisions

  1. These Rules and Regulations ("Regulations") are issued by the Organizer based on the Act of March 20, 2009 on the safety of mass events and the Act of April 23, 1964 - Civil Code.
  2. The following definitions shall apply:
  1. Organizer – Daniel Majewski conducting business activity under the name DM PROMOTION Daniel Majewski, ul. Juliusza Kossaka 2, 05-250 Radzymin, NIP: 8982205706,
  2. Security Services/Information Services – persons appointed by the Organizer to ensure and maintain the safety of Participants, including security staff carrying an ID badge,
  3. Event Area – the area of Centrum EXPO XXI where the Event takes place,
  4. Participant – a person present at the Event Area and participating in the Event,
  5. Act – the Act of March 20, 2009 on the safety of mass events.
  1. The purpose of these Regulations is to ensure safety and order during the Event, to specify the rules of participation in the Event, and the rights and obligations of Participants.
  2. Purchasing a ticket and entering the Event Area implies acceptance of the Regulations.
  3. The Regulations apply to all Participants, employees of Security and Information Services, and other persons on the Event Area. Every person present at the Event Area is obliged to comply with the Regulations.



§ 2. Conditions of Participation in the Event

  1. Entrance to the Event is permitted only to adults holding a valid ticket issued by the Organizer entitling them to participate.
  2. Participants are required to present their ticket along with valid identification upon request by Security or Information Services.
  3. Tickets may be exchanged for a wristband issued by the Organizer, authorizing access to designated zones within the Event Area for Participants with the appropriate ticket type.
  4. A ticket entitles the holder to a one-time entry to the Event Area. Once leaving the entrance gates, re-entry with the same ticket is not possible.
  5. If a person with a disability wishes to participate in the Event with a carer, both must hold tickets.
  6. The Organizer reserves the right to make changes to the Event program, including schedule and artists, without Participants being entitled to compensation and/or damages. Changes do not entitle ticket refunds.
  7. The Organizer may cancel the Event, change the location and/or date for reasons beyond their control (particularly force majeure, illness or unavailability of invited artists, administrative decisions, safety reasons).
  8. In the event of a date change, the Participant may choose to:
  1. keep the purchased ticket and participate in the Event at the new date, or
  2. resign from the purchased ticket and receive a refund of the ticket price as publicly announced by the Organizer and the service fee paid with the ticket price.
  1. If the Participant decides to keep the purchased ticket and participate at the new date, the ticket remains valid, regardless of possible changes in ticket prices.
  2. If the Participant decides to resign from the ticket due to change of date, the ticket price refund and the service fee will be processed in the same manner as in the case of cancellation without a new date being set. The refund period shall begin from the day the Participant submits the resignation statement.
  3. If the Participant does not make a choice at least 30 days before the new Event date (whether to keep the ticket or request a refund), it is understood that the Participant has decided to keep the purchased ticket and will participate at the new date. After this deadline, the Participant cannot resign and claim a refund.
  4. In the event of cancellation of the Event without a new date, the Organizer is not obliged to pay any compensation and/or damages to the ticket holder, except for refunding the ticket price publicly announced by the Organizer and the service fee paid with the ticket price.
  5. If the venue or date of the Event is changed or the Event is cancelled, the Participant will be informed via email and an announcement on the Organizer's website.



§ 3. Safety Rules

  1. Entry to and participation in the Event is prohibited for anyone against whom a final ruling has been issued:
  1. prohibiting participation in mass events, or
  2. requiring avoidance of locations where mass events are held.
  1. The Organizer may refuse entry and participation in the Event to any person:
  1. under the influence of alcohol, drugs, psychotropic substances, or similar agents,
  2. refusing to undergo checks to verify eligibility to attend, identification, or luggage/clothing inspection if suspected of bringing/possessing prohibited items as per Art. 8(2) of the Act,
  3. possessing weapons or other dangerous items, explosives, pyrotechnics, alcoholic beverages, intoxicating or psychotropic substances,
  4. behaving aggressively, provocatively, or otherwise threatening safety or order at the Event.
  1. Persons refused entry or removed from the Event Area due to breach of these Regulations or of the law are not entitled to a ticket refund.
  2. It is forbidden to bring to the Event Area:
  1. weapons, ammunition, or other dangerous items,
  2. explosives, pyrotechnic materials, fireworks, flares, smoke candles,
  3. alcohol, drugs, and psychotropic substances,
  4. sports clubs’ symbols or colors,
  5. any materials containing racist, xenophobic, vulgar, provocative, or ideological/political content,
  6. paints, sprays, dyes, aerosols,
  7. helmets, scooters, or bicycles,
  8. glass or metal containers,
  9. drones or other flying devices,
  10. professional photo-video equipment, laser pointers, tripods, selfie sticks, tablets, laptops, any audio-video devices (except mobile phones);
  11. bags larger than 20 cm x 25 cm x 13 cm,
  12. sound systems, lasers, or other devices that may disturb the Event.
  1. The following are prohibited at the Event Area:
  1. bringing animals,
  2. wearing clothing with dangerous elements (e.g., metal shoe inserts) or that in the Organizer’s opinion constitutes promotion,
  3. trading without Organizer’s consent,
  4. smoking outside designated areas,
  5. entering technical infrastructure or areas not designated for Participants,
  6. throwing objects, lighting fires, destroying property or facilities,
  7. relieving oneself outside toilets and littering the Event Area,
  8. occupying communication routes or evacuation routes without justification,
  9. using venue devices contrary to their purpose;
  10. use of physical violence or making threats towards any Event participant, including other Participants.
  1. The Organizer shall ensure safety for attendees, including:
  1. service by trained Security and Information staff led by a Security Manager appointed by the Organizer,
  2. medical aid, including an ambulance and a walking medical patrol,
  3. evacuation routes marked in accordance with current law,
  4. fire protection.
  1. Security and Information Staff are authorized in accordance with the Act to:
  1. check and verify the eligibility of persons to participate and, if not eligible, request they leave the Event Area,
  2. check authorization for presence in specific zones within the Event Area,
  3. control the number of places available in each zone and temporarily limit access if Participant numbers exceed permissible limits,
  4. identify persons for identity verification,
  5. inspect baggage and clothing if there is suspicion of prohibited items as per Art. 8(2) of the Act,
  6. issue orders to those disturbing public order or failing to comply with the Regulations or site rules and, if ignored, ask them to leave the Event Area,
  7. apprehend, for immediate transfer to the Police, any persons posing direct threats to protected assets or committing illegal acts,
  8. use physical force, including restraining and self-defense techniques, if necessary to protect assets or repel an attack, under the Act's provisions.
  1. Participants must comply with the instructions of Security and Information Services and Organizer’s announcements.



§ 4. Event Procedure. Recording and Photography

  1. The Organizer establishes the following zones at the Event Area:
  1. General Admission Area,
  2. VIP Area,
  3. DJ Backstage Area,
  4. Technobus Area,
  5. Gastronomic Area (not part of the Event Area; only here can purchased or served alcohol and food be consumed),
  6. External area with smokers’ and food court,
  7. Technical/social area (not accessible to Event Participants).
  1. Access to specific zones is permitted only to persons holding the proper ticket, to be exchanged for a wristband granting access.
  2. Security and Information Services may check Participants’ access at the entry points to each zone.
  3. Participants must not attempt to enter zones for which they lack authorization.
  4. The Organizer may temporarily restrict access to a zone if its capacity is exceeded or for other safety reasons.
  5. Security Services may refuse access to those whose wristbands are damaged, illegible, or questionable in authenticity.
  6. Live music will be performed using sound equipment, light effects, and strobe lights may be used during the Event.
  7. Only reporters and journalists who have received proper and current press accreditation from the Organizer may record the Event’s proceedings.
  8. The Organizer reserves the right to record the Event for documentation and promotional or advertising purposes related to this Event and future events, for the Organizer’s, sponsors’, and partners’ needs. Images of Participants may be recorded and further disseminated for documentation, reporting, advertising, and promotional purposes, in circumstances provided for by law, including publication on social media (where the participant's image is an element of the background or entire recorded scene).
  9. By participating in the Event, the Participant consents to the recording and exploitation of their image as set out above, especially including fixation and reproduction, distribution, broadcasting, exhibition, presentation, playback, as well as public making available in a manner that enables anyone to access it at a time and place of their own choosing. The image will not be specially processed to allow identification.
  10. Any photos taken by Participants during the Event may be made exclusively for private use, and photography should not disturb other Participants or the Event.



§ 5. Responsibilities and Rights of Participants and Organizer

    1. A Participant has the right to:

      1. stay on the Event Area during the Event, i.e. from the moment the Organizer opens the gates until its end,
      2. freely participate in the Event, only restricted by legal regulations, these Regulations, and generally accepted principles of social coexistence,
      3. receive information about:
  • location of medical, food, and sanitary points;
  • facilities and safety requirements determined by the Organizer or rescue services,
      1. report to representatives of the Organizer, including Security and Information Services, any damage suffered at the Event Area during the Event,
      2. submit complaints.
    1. The Participant is obliged to:

      1. follow these Regulations,
      2. carry and present upon request of Security/Information Services an ID document,
      3. follow the orders of Information and Security Services, the Organizer, and in case of intervention, the Police, State Fire Service, Border Guard, Military Police, or other authorized officials,
      4. not disturb public order,
      5. remain exclusively within the spaces clearly designated by the Organizer as accessible to Participants,
      6. not threaten the safety of other persons present at the Event,
    2. The Organizer is not responsible for items brought by Participants onto the Event Area.
    3. Participants are liable for any damage caused at the Event Area.
    4. During the Event, without the Organizer’s consent, it is prohibited to: take photos, record, or capture the Event by any means without the knowledge and permission of the Organizer.
    5. If this prohibition is violated, Security Services or staff may expel the offending person from the Event Area.
    6. Anyone who fails to comply with an order issued by the Organizer, Security, or Information Services based on the Act is subject to a penalty of arrest, restriction of liberty, or fine.
    7. Anyone bringing or possessing weapons, other dangerous items, explosives, pyrotechnics, or fire-hazardous materials at the Event is subject to arrest or imprisonment.
    8. Persons frequently violating the provisions of the Act will be removed from the Event Area or handed over to the Police.
    9. Persons violating safety and order rules at the Event Area will be held criminally and administratively liable.



§ 6. Complaints

  1. All complaints can be submitted in writing within 21 days after the end of the Event to the Organizer’s correspondence address: ul. Juliusza Kossaka 2, 05-250 Radzymin.
  2. A complaint should include the name and mailing address of the complainant, as well as the cause of complaint and requested resolution.
  3. The Organizer shall consider properly submitted complaints within 21 days of their delivery.
  4. Use of the complaint procedure is voluntary and is not a prerequisite for pursuing claims.



§ 7. Rules of Recording the Event and Data Processing

  1. The Organizer is entitled to record the course of the Event, including the behavior of the participants, via devices registering image and sound.
  2. Materials collected during the Event that may serve as evidence for criminal proceedings or in cases of offences, or may be relevant to such proceedings, will be promptly handed over by the Organizer to the district prosecutor or appropriate local police commander, as needed, unless the Organizer reports the crime or requests prosecution themselves.
  3. Materials not containing such evidence are stored by the Organizer after the Event for at least 30 days, but no longer than 90 days, and then destroyed.
  4. The Organizer declares to be the data controller within the meaning of Art. 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) (hereinafter, "Administrator").
  5. The Organizer appoints a Data Protection Inspector, who can be contacted via email at [email protected] regarding data processing and rights.
  6. Personal data are processed to conclude and perform a contract, including, in particular, registration, confirmation of participation, sending organizational information to Participants, fulfilling legal obligations of the administrator, and seeking or defending against possible claims arising from the contract.
  7. The processing of data is necessary to conclude and perform the contract as per Art. 6(1)(b) GDPR.
  8. Data may also be processed for documentation, promotional, or marketing purposes relating to the Event and the activities of the Organizer.
  9. Personal data are processed according to Art. 6(1)(f) GDPR in connection with Art. 81(2)(2) of the Act on Copyright and Related Rights, for all Participants present at the Event Area who accept these Regulations. The legitimate interest of the Administrator is making recordings documenting the Event and using them for promotional purposes.
  10. Data are also processed to secure information, including evidence, in case of claims or defense against them, and to fulfill legal tax obligations (Art. 6(1)(c) GDPR).
  11. Data will be provided only to entities supporting the Administrator (e.g. legal, accounting, auditing, HR, or IT services), and to entities contracted to organize parts of the Event, acting solely on the Administrator's orders; data may also be disclosed to certain entities authorized by law.
  12. The Administrator does not plan to transfer data to third countries or international organizations.
  13. Data will be stored for the limitation period of possible claims arising from the contract. Accounting documents will be stored as required by tax law. Data in recordings from the Event will be processed for as long as necessary for promotional/marketing activities, and later for indeterminate time as Event documentation.
  14. Received data will not be subject to automated decision-making or profiling.
  15. Persons whose data is processed have the right to:
  • access their personal data,
  • request rectification of their personal data,
  • request erasure or restriction of processing,
  • object to processing,
  • request data transfer to another controller.
  1. If data processing is based on the data subject's consent, this can be withdrawn at any time, without affecting the lawfulness of processing carried out before withdrawal.
  2. If a data subject believes their personal data is being processed contrary to GDPR, they have the right to lodge a complaint with the President of the Personal Data Protection Office.
  3. The provision of data is voluntary, but necessary for cooperation with the Administrator.



§ 8. Final Provisions

  1. All rights to the Event name and logo are reserved by the Organizer. Official programs and merchandise related to the Event will be sold only on the Event Area or at points authorized by the Organizer.
  2. Sponsor status regarding the Event may only be granted by the Organizer.
  3. The Organizer has the right to change the Regulations, particularly to ensure the proper conduct of the Event and the safety of Participants.
  4. The Regulations are available: at the entrance gates to the Event Area and on the Organizer's website.
  5. In matters not regulated herein, the provisions of the Act and the Civil Code shall apply.
  6. These Regulations enter into force on November 25, 2025.
